By purchasing or using our services, you agree to these Terms.

Toribio Digital provides digital marketing, automation, customer communication, AI receptionist, CRM, appointment scheduling, and related technology services for businesses.
Our services may include:

Automated workflows
SMS and other communication services
Specific services included in your subscription or service agreement will be described at the time of purchase.
2. AI Receptionist Services
Our AI receptionist services use artificial intelligence and automated technology to communicate with callers and customers.
AI-generated responses are intended to assist with routine customer interactions and administrative tasks.
AI systems may occasionally provide inaccurate, incomplete, or unexpected information. Customers should verify important information before relying on it.
Toribio Digital does not guarantee that an AI receptionist will correctly understand or respond to every caller or request.
3. Customer Responsibilities
Customers are responsible for providing accurate business information, including:
Business hours
Services
Pricing
Location information
Appointment availability
Frequently asked questions
Contact information
Policies and other information provided to the AI system
Customers are responsible for reviewing and maintaining the accuracy of information used by their AI receptionist and automated systems.
4. Appointments and Customer Communications
Toribio Digital may provide tools that allow customers to schedule appointments, receive messages, or communicate with businesses.
Toribio Digital does not guarantee that every appointment, message, lead, or customer interaction will be successfully completed.
Customers are responsible for monitoring their business communications and following up with customers when appropriate.
5. Subscription Services
Certain Toribio Digital services may be offered on a recurring monthly subscription basis.
Unless otherwise stated, subscription fees are billed according to the plan selected at the time of purchase.
Your subscription will continue until canceled in accordance with the applicable cancellation terms.
6. Fees and Payments
Customers agree to pay all applicable fees for the services selected.
Payment information must be accurate and current.
If a payment fails or an account becomes past due, Toribio Digital may suspend or restrict access to services until the outstanding balance is resolved.
Third-party processing fees or usage-based charges may apply to certain services.
7. Cancellation
Customers may request cancellation of recurring services according to the cancellation terms associated with their subscription or service agreement.
Cancellation does not automatically eliminate amounts already owed for services that have already been provided.
8. Third-Party Services
Toribio Digital may use third-party platforms, software, telecommunications providers, payment processors, AI providers, hosting providers, and other technology services to deliver our services.
The availability and functionality of third-party services may be outside of our control.
Third-party services may have their own terms, conditions, and privacy policies.
9. SMS and Telephone Communications
Certain services may involve telephone calls, text messages, or other electronic communications.
Where required, customers are responsible for obtaining appropriate consent from their customers before sending marketing or other communications.
Customers must comply with applicable telecommunications, marketing, privacy, and consent laws.
Message and data rates may apply to SMS communications.
For SMS programs, users may opt out by replying STOP where applicable and may request assistance by replying HELP.
Carriers are not responsible for delayed or undelivered messages.
HighLevel's current A2P guidance specifically requires appropriate opt-out/support language and links to both Privacy Policy and Terms & Conditions when applicable.
10. Prohibited Uses
Customers may not use Toribio Digital services for unlawful, fraudulent, abusive, deceptive, or harmful activities.
Customers may not use our services to violate applicable laws, regulations, telecommunications requirements, privacy laws, intellectual property rights, or the rights of others.
11. Intellectual Property
Toribio Digital and its licensors retain ownership of our software, technology, systems, branding, templates, workflows, processes, and other proprietary materials unless otherwise agreed in writing.
Customers retain ownership of their own business information and content that they provide to us, subject to the rights necessary for us to provide the contracted services.
12. Service Availability
We work to maintain reliable services, but we do not guarantee that our services will always be uninterrupted, error-free, or available.
Services may occasionally be affected by maintenance, technical problems, internet outages, telecommunications issues, third-party services, or circumstances outside our reasonable control.
13. No Guarantee of Business Results
Toribio Digital does not guarantee any specific number of leads, appointments, customers, sales, revenue, reviews, or other business results from the use of our services.
Business results depend on numerous factors outside of our control.
14. Limitation of Liability
To the maximum extent permitted by applicable law, Toribio Digital will not be responsible for indirect, incidental, special, consequential, or punitive damages arising from or related to the use of our services.
To the maximum extent permitted by law, our total liability relating to a service will not exceed the amount paid by the customer to Toribio Digital for that service during the applicable period preceding the event giving rise to the claim.
15. Indemnification
To the extent permitted by applicable law, customers agree to defend and hold harmless Toribio Digital from claims, damages, liabilities, and expenses arising from the customer's misuse of the services, violation of these Terms, or violation of applicable law.
16. Privacy
Our collection and use of personal information is described in our Privacy Policy.
17. Changes to These Terms
We may update these Terms from time to time.
When we make changes, we will update the Effective Date at the top of this page.
Continued use of our services after an updated version becomes effective constitutes acceptance of the updated Terms, to the extent permitted by applicable law.
18. Governing Law
These Terms will be governed by applicable laws of the State of New York, without regard to conflict-of-law principles, unless otherwise required by applicable law.
